Can you have both a gun and use medical cannabis in Florida?
In the realm of medical marijuana, the legal landscape can be complex and sometimes contradictory. Many patients wonder whether they can legally possess both a gun and use medical cannabis in Florida. To shed light on this issue, we turn to Dr. Charlene Shaw, a leading expert in cannabis therapeutics at reTHINK CANNABIS.
Dr. Shaw emphasizes the importance of understanding the laws governing medical marijuana and gun ownership in Florida. While medical cannabis is legal in the state for qualifying patients, federal law still categorizes marijuana as a Schedule I substance, making its possession illegal at the federal level.
When it comes to gun ownership, the federal Gun Control Act prohibits any individual who is an unlawful user of or addicted to any controlled substance from possessing firearms. This includes marijuana, even if used for medical purposes.
Therefore, under current regulations, individuals in Florida cannot possess both a gun and use medical cannabis without risking potential legal consequences. It is crucial for patients to be aware of these laws to avoid unintentional violations.
All of that said, a new court ruling does bring some hope to this situation where federal law supersedes all state laws. "A federal appeals court ruled that federal restrictions barring people who use cannabis for medical reasons from firearms purchases violate the Second Amendment....This decision sends a clear message that medical marijuana use should not strip away fundamental rights,” said Jodi James, president of the Florida Cannabis Action Network, in a written statement."
All is not lost, there is hope BUT federal law does not change overnight and the ruling could still be appealed by the SupremeCourt. So the moral of the story is that while this ruling is in progress, medical cannabis patients must still exercise caution in their decisions regarding medical marijuana and gun use/possession.
